The Office of the U.S. Trade Representative (USTR) released a list of exclusions that pertain to List 1, List 2, and List 3 of the China 301 tariffs. In total, 437 commodities were excluded from these duties and are now eligible for retroactive refunds of duty paid.
These exclusions are available for any product that meets the description in the Annex of the Federal Register Notice. The scope of the request is governed by the scope of the Harmonized Tariff Schedule, not by the importer or the description in the text of the exclusion request.
If your company is currently being assessed the 301 tariffs, your company should be reviewing the exclusion lists as they are issued.
