US Customs Issues a Ruling on “Festive Articles” in Heading 9505 as the Holiday Season Approaches

On August 18th, US Customs issued a ruling on lighted, glass, cone-shaped trees.   These decorations were deemed not to be ‘festive articles’ eligible to be classified under the heading 9505.  In the ruling, CBP stated that these trees did not meet the two pronged eligibility guidelines.  In order to be classifiable under this tariff, the goods must be 1) closely associated to a festive occasion, and 2) displayed principally during that festive occasion.  These goods were determined to be classifiable under either 7010 or 7018 as articles of glass.
