U.S. Section 232 Tariffs & Canadian Countermeasures

On May 31st, The United States ended the Canadian exemption from the Section 232 tariffs on steel and aluminum articles.

The U.S. proclamation defined steel articles subject to the additional duties in the Harmonized Tariff Schedule as:

• 7206.10 through 7216.50
• 7216.99 through 7301.10
• 7302.10
• 7302.40 through 7302.90
• 7304.10 through 7306.90

The U.S. proclamation defined aluminum articles subject to the additional duties in the Harmonized Tariff Schedule as:

• HTS 7601 – Unwrought aluminum
• HTS 7604 – Aluminum bars, rods, and profiles
• HTS 7605 – Aluminum wire
• HTS 7606 and 7607 – Aluminum plate, sheet, strip, and foil (flat rolled products)
• HTS 7608 and 7609 – Aluminum tubes and pipes and tube and pipe fitting
• HTS 7616.99.5160 – Aluminum castings
• HTS 7616.99.5170– Aluminum forgings

The Department of Finance Canada subsequently announced countermeasures levying duty on U.S. origin goods beginning July 1st 2018. These countermeasures will remain in place until the U.S. eliminates its trade-restrictive measures against Canada.

The 25% retaliatory tariffs for U.S. origin steel articles include:
• 7206 through 7215
• 7216.10 through 7216.22
• 7216.50
• 7216.99
• 7217 through 7229
• 7301.10
• 7302.40 and 7302.90
• 7304.11 and 7304.19
• 7304.24 through 7304.90
• 7305 through 7306

Canada expanded the list beyond aluminum to include foods, household items, and consumer goods. The following items will be assessed a 10% rate on July 1st:

Foods:
• 0403.10 – Yogurt
• 0901.21 – Coffee, roasted: Not decaffeinated
• 1602.32.11, 1602.32.92, 1602.50.10, and 1602.50.99 – Prepared meat
• 1702.20 – Maple sugar and Syrup
• 1704.90.20 and 1704.90.90 – Candy
• 1806.31 and 1806.32 – Chocolate bars
• 1905.90.51 – Pizza and Quiche
• 2001.10 – Cucumbers and Gherkins
• 2007.99.10 – Strawberry jam
• 2007.99.90 – Peanut butter and fruit purees
• 2009.12 – Orange juice
• 2103.10 through 2103.90 – Soya sauce, ketchup and tomato sauce, mustard, mayonnaise, salad dressing, condiments, seasonings
• 2104.10 – Soups
• 2202.10 – Soda, waters with sweeteners
• 2208.30 – Whiskies

Household Items:
• 3304.30 – Manicure, pedicure preparations
• 3305.30 – Hair lacquers
• 3307.10 – Shaving preparations
• 3307.49 – Air fresheners
• 3401.30 – Soaps
• 3402.20 – Dishwashing detergents
• 3406.00.90 – Candles
• 3506.10 – Glues and adhesives
• 3808.91.10 – Insecticides, 3808.92.10 – Fungicides, 3808.93.10 – Herbicides
• 3923.21.90 and 3923.29.90 – Plastic bags
• 3924.10 and 3924.90 – Plastic household articles
• 4412.39 and 4412.99.90 – Plywood (< 6mm thickness) and other plywood and veneered panels
• 4802.56 – Other paper and paperboard
