The U.S. Trade Representative (USTR) published a Federal Register announcing the exclusion requests from the 25 percent duty assessed under the Section 301 China duty investigation. The product exclusions announced in this notice will apply as of the July 6, 2018 effective date and will extend for one year after the publication notice on July 9th, 2019.
The exclusions are available for any product that meets the description in the Annex of the Federal Register (84 FR 32821), regardless of whether the importer filed an exclusion request. The scope of each exclusion is governed by the scope of the product descriptions in the Annex, not by the product descriptions set out in the particular request.
Duty exclusions granted by the USTR are retroactive on imports to the initial effective date of July 6, 2018. To request an administrative refund for previous imports of duty-excluded products granted by the USTR, importers may file a Post Summary Correction on un-liquidated entry summaries or a protest on liquidated entries.
