The Food and Drug Administration (FDA) starting increasing enforcement of the Foreign Supplier Verification Program (FSVP) to include all importers that fail to meet requirements. This enforcement has included the issuance of warning letters and the re-inspection of previous violators. The warning letters threaten to list violations on the new 99-41 import alert list.
These warning letters come on the heels of The U.S. Food and Drug Administration releasing their inspection statistics relating to the Foreign Supplier Verification importer compliance. According to the report by the National Customs Broker’s Association (NCBFAA), only 36 percent of all importer inspections resulted in a passing grade. In contrast, 76 percent of foreign facilities received a passing grade.
We encourage our clients to reach out to their U.S. buyers and provide information relating to FSVP compliance.
