Under the CPTPP, although no longer a requirement, the CBSA will accept a completed certificate of origin [rather than a declaration, or statement]. However, between the certificate of origin and the other paper work (commercial invoice, bill of lading, etc.), all of the information required in Annex 3-B of the agreement must be present in order to claim preferential treatment under CPTPP.
Annex 3-A, para. 7, allows the Canada Border Services Agency (CBSA) to accept a certification of origin, that is completed by a competent authority, to be taken in the same manner as a certificate of origin that was produced by the producer of the goods. This does not override the minimum data requirements of Annex 3-B. The authority who completed the certificate must include all required data elements.
The wording on the certificate does not need to match exactly what is included in Annex 3-B. The CBSA will accept other phrasing as long as the statement provided is similar in content to that of what is found in Annex 3-B.
