Some exporters from Vietnam are using a formal declaration of origin that does not comply with Annex 3-B of the CPTPP. In most cases, this is due to the fact that the following statement is not included:
I certify that the goods described in this document qualify as originating and the information contained in this document is true and accurate. I assume responsibility for proving such representations and agree to maintain and present upon request or to make available during a verification visit, documentation necessary to support this certification.
CBSA has advised:
We have written to the Vietnamese Minister of Industry and Trade requesting that they advise their competent authorities of Vietnam to apply a form that is compliant with Annex 3-B of the CPTPP. We are working to rectify the situation and will continue to advise you of any updates.
In the meantime, although an inconvenience for traders, we advise the importer to seek a corrected CO that contains the minimum data requirements set out in Annex 3-B.
