Recently Canada Border Services Agency (CBSA) updated D-memo 10-18-1 Tariff Quota Rates.
An inconsistency was noted concerning the validity period of import permits between the D-memo and Global Affairs Canada. Â CBSA has clarified the following:
- In the permit application, the importer must provide an entry date. This entry date sets the limits for the validity of the permit and timeframe when the importer can apply for a permit;
- Applying for a permit: you can normally apply for the permit 30 days prior to the entry of the shipment – 29 days prior plus date of entry = 30 days; and
- Validity of the permit: import permits will normally be issued with a validity period of 30 days around the entry date specified by the importer – 5 days prior to it, date of entry, plus 24 days = 30 days. It should be noted import permits are no longer valid when a new quota year begins. For example, for calendar year tariff rate quotas, if you apply for a permit on December 15 it expires December 31 as the new quota year would begin on January 1.
CBSA will amend the wording in D10-18-1 to provide clarity as soon as practical.
