Canadian Environmental Protection Act and Emissions regulations

Environment and Climate Change Canada while conducting inspections of importers of certain regulated petroleum burning machines found that many importers have not provided the required pre-arrival declaration to the Minister or declaration to Canada Border Services Agemcy.

The Canadian Environmental Protection Act 1999(CEPA) Division 5 deals with Vehicle, Engine and Equipment Emissions.
Section 149 of the act defines what is an engine and what is a vehicle.

Section 153(1) states that no vehicle, engine, or equipment can be imported unless it meets the standards set out in the subsection.

Section 160 allows the Governor in Council to make regulations respecting emissions and information to be submitted under section 153.

The following regulations apply to Division 5:

Marine Spark-Ignition Engine, Vessel and Off-Road Recreational Vehicle Emission Regulations
Off-Road Compression-Ignition Engine Emission Regulations
Off-Road Small Spark-Ignition Engine Emission Regulations
On Road Vehicle and Engine Emission Regulations
Passenger Automobile and Light Truck Greenhouse Gas Emission Regulations
Heavy-duty Vehicle and Engine Greenhouse Gas Emission Regulations

The Marine Spark-Ignition Engine, Vessel and Off-Road Recreational Vehicle Emission Regulations, Off-Road Compression-Ignition Engine Emission Regulations and the On Road Vehicle and Engine Emission Regulations all require a pre-arrival declaration to be sent to the Minister.  Information on how this is to be done is available on the Environment and Climate Change Canada website in the CEPA registry.

The following codes have been identified by Environment Canada (APPENDIX IX) as being likely to fall under the Off-Road Compression-Ignition Engine Emission Regulations.

A fact sheet has been developed to assist persons and companies in determining if they are subject to the Regulations or not. The fact sheet is also a good first step to get a sense of the different general requirements of the Regulations.
