FSVP News Brief – Produce Safety Rule Compliance Date

As we approach an important implementation date of the Food Safety Modernization Act (FSMA), Willson International would like to provide our produce clients additional resources to assist with the Foreign Supplier Verification Program (FSVP) and the impact it will have on your shipments to the United States.
If you have not yet reviewed the FDA’s final rule on the Foreign Supplier Verification Program (FSVP), please take some time to review the document. The final rule can be found here:
 
What information will be needed on May 30th, 2017?
A DUNS number and the buyer or recipient’s FSVP contact name, phone number, and email address. It is important to note that, for a limited time, the option of ‘UNK’ will be available if the US party does not have a DUNS number. Also, a DUNS number can be found using the DUNS number lookup tool available here: https://fdadunslookup.com/ . The contact name, phone number, and email address will still be required in order to transmit the entry to US Customs and the FDA.
 
How is the FSVP information sent to Willson International?
For customers utilizing our ShipCheck platform, accommodations have already been made allowing FSVP information to be input and stored within the program.
For companies creating commercial or proforma invoices for shipments, please include the FSVP information on the commercial or proforma invoice.
Compliance Date for Produce subject to the FSMA Produce Safety Rule
 
As many produce exporters already know, produce that is typically consumed raw is already regulated by the FSMA Final Rule on Produce Safety. The final rule can be found here:
Therefore, if your goods are regulated by this rule and your company is in proper compliance with the “FSMA Final Rule on Produce Safety,” the FSVP information will not be required until July 26th, 2018 if your company wishes for the information to be disclaimed on those items. If this is the case for some of your produce items, please complete and return the attached form advising Willson International that your company wishes to utilize the FSVP disclaim option on your items that are regulated by the FSMA Final Rule on Produce Safety. Please note that the FSVP information is reported per item. Therefore, if you have one item that your company is eligible to disclaim, and one item not eligible, the FSVP information will still be needed in order to have the shipment cleared by the FDA.
